Mandatory Commercial Recycling (AB 341)
As of July 1, 2012, AB 341 requires that businesses generating four cubic yards or more of solid waste per week, and multi-family apartment units of five or more, must recycle. The method of recycling depends on which collection methods are available in your geographic area.
Who Must Recycle
AB 341 (Chesbro, 2011) mandates that the following businesses must arrange for recycling services:
- Any business that generates 4 cubic yards or more of waste per week; and
- Multi-family buildings with five or more units.
How to Become AB 341 Compliant
Recycling services can be arranged by any of the following waste haulers: Recology Eel River (707) 725-5156, Recology Eureka (707) 442-5711, Humboldt Sanitation (707) 839-3285, Blue Lake Garbage (707) 444-2903 or Tom’s Trash (530) 629-2070.
- Multi-family unit residents must place separated recyclable materials in bins or containers that are provided from a waste hauler.
- A business may also donate, sell and/or make other arrangements for pick up and recycling of the materials.
- Business owners have the option of self-hauling the recyclables to the nearest designated drop off area.
Benefits of Recycling
- The more recyclable materials a business can divert from their trash, the greater the potential savings and reduction in solid waste related costs.
- Recycling conserves resources and reduces greenhouse gas emissions. It also extends the life of our landfills by limiting the space used up from recyclable materials.
Items not Accepted in Recycling Bins
- Hazardous waste such as batteries, paint, chemicals and cleaning products should not be mixed in with your recyclable materials set out for collection. Instead, these hazardous materials should be recycled or disposed of properly. - Electronic devices such as computer towers, monitors, TVs, and stereo equipment are recyclable, but also contain hazardous materials. They should not be placed in the recycling or trash bins that are provided. For more information about how to manage these items contact the nearest hauler from the list above.

For Business Owners
Your employees are the key to a successful recycling strategy for businesses.
- Educate employees on which materials can be recycled and where to place them in preparation for collection.
- Encourage employees to take the extra step to separate recyclable materials from trash.
- Place recycling containers throughout the workplace, such as at each desk, in break rooms and in high traffic areas.
For Apartment Owners and Managers
It is important that both apartment managers and tenants understand the requirements to recycle, which materials can be recycled and where to place them for collection.
- State law requires multi-family buildings with 5 or more units to recycle.
- State law requires apartment owners to offer recycling services to residents. Apartment owners may mandate that all tenants are to recycle.
- Notify new tenants of the recycling requirements, and send a letter to current tenants yearly reminding them to utilize recycling options.
